Protective Costs Orders

 
A Protective Costs Order (PCO) is where the court makes an order, usually at the beginning of a case, that a party will not be required to pay another party's costs, or their costs liability will be limited in advance, regardless of the outcome of the case. A court may consider making a PCO in a case of general public importance and where it is fair and just to do so, having regard in particular to the financial resources of the parties and the likely costs in the case.
